Real Estate Law

Our firm's real estate practice is sophisticated and diverse.  We provide "cradle to grave" real estate legal services for our varied client base.  From property acquisitions, to land use entitlement, design, construction, marketing, leasing and property management services, to structuring financings, equity participations, joint ventures and partnerships, to land and building sales and dispositions, our real estate practice touches most aspects of property law.  We handle real estate matters ranging from personal investments and transactions for our clients, to multi-million dollar commercial, residential and farm/ranch acquisitions and developments.  Our hotel and resort practice takes our lawyers to vacation destinations to assist our clients in this fast-growing segment of the real estate development business.  We routinely prepare zoning and land use covenants, all types of community association documents, development agreements, annexation agreements, financing documents, design and construction contracts and all other documentation associated with real estate development.  We assist many of our clients in realizing their dreams of permanently protecting the significant attributes of their properties through conservation easements and other non-development agreements.  Our water law and commercial litigation practice areas compliment our real estate practice by providing technical support in those areas when needed.

Water Law

Our water law attorneys are recognized leaders in Western water law.  We have developed and implemented complex and innovative water supply plans (including domestic use and snowmaking supplies) for numerous residential, commercial and ski area clients.  Our work includes evaluating and documenting complex water sales and acquisitions; adjudicating water rights, change of water rights, and augmentation and exchange plans; well permitting; dam permitting consultation; and water right analyses in a variety of contexts.  Our firm also performs water rights title research in connection with large ranch acquisitions and water ownership disputes.  Our firm’s water rights adjudications and counseling concern all types of water rights recognized under Colorado law, including storage reservoirs; gravel pits; irrigation ditch interests; Colorado-Big Thompson (CBT) units and Windy Gap units; tributary and nontributary groundwater; designated ground water; and shares in mutual ditch and reservoir companies.  We practice in all of the water courts in Colorado, as well as in administrative proceedings before the Colorado Division of Water Resources, Office of the State Engineer, and the Colorado Ground Water Commission.  Water rights issues are frequently intertwined with real property ownership and regulatory issues such as easements or other legal authorizations pertaining to water rights structures on private and public lands.  Accordingly, our water practice often complements the firm’s ongoing real estate and land use work (and vice-versa) and together these areas of practice provide clients with a full range of services on real estate-related projects.

Land Use Matters

In addition to handling land use matters for our real estate and water clients, we have represented numerous clients with matters before city, county and state land use commissions and boards.  Our attorneys have experience working with land use directors, land use staff, land use boards and governmental attorneys to pursue and obtain governmental action.  This includes pre-application strategy, handling of land use applications, appearances at public hearings and creating records on appeal when necessary.  We have also successfully represented clients in opposing and challenging land use applications pursued by adverse parties.  We have successfully represented our clients in District Court and Appellate Courts in overturning adverse land use decisions.  We have testified before State of Colorado Senate and House Committees concerning land use and water matters on behalf of our clients.

Commercial Litigation

Our firm has an active commercial litigation practice and is prepared to see cases through trial and appeal when needed.  Our firm practices in all areas of commercial litigation, and features particular expertise in real estate, eminent domain, construction, construction defect, land use, partnership, commercial loan workouts and foreclosures, and general business litigation.  We represent our clients in pre-litigation dispute resolution, mediation, arbitration and at trial.  Our firm seeks to identify each client’s goals prior to commencement of litigation so that case strategy can be tailored to each client’s individual goals.  Our attorneys also have substantial experience advising and helping clients avoid litigation when litigation is threatened against our clients.  Once in litigation, our attorneys have extensive expertise in conducting discovery, responding to discovery and handling experts.  Our attorneys have experience with insurance law, understand how to invoke insurance coverage, and are comfortable negotiating with insurance defense attorneys.  We also have an active property tax appeal practice and assist our clients in maintaining appropriate valuation of their real property for tax purposes.  We represent a diverse client base in litigation matters including property owners, developers, landlords and tenants, homeowner’s associations, lending institutions and business owners.  Our attorneys have successfully tried cases to many juries, trial courts and arbitrators, and successfully appeared before several appellate courts.

Environmental Matters

Our environmental expertise allows us to handle all environmental issues related to water, real estate or land use matters including environmental audits, indemnification agreements, water quality and wetland issues.  Our prior experience includes representing clients before the Water Quality Control Commission, obtaining various environmental permits from state and federal agencies, representing clients involved with hazardous waste cleanup under CERCLA and regulatory compliance, including abatement.  Our clients include many major land development companies and individuals, including those previously mentioned.
