Our firm’s real estate practice is sophisticated and diverse.  We provide “cradle to grave” real estate legal services for our varied client base.  From property acquisitions, to land use entitlement, design, construction, marketing, leasing and property management services, to structuring financings, equity participations, joint ventures and partnerships, to land and building sales and dispositions, our real estate practice touches most aspects of property law.  We handle real estate matters ranging from personal investments and transactions for our clients, to multi-million dollar commercial, residential and farm/ranch acquisitions and developments.  Our hotel and resort practice takes our lawyers to vacation destinations to assist our clients in this fast-growing segment of the real estate development business.  We routinely prepare zoning and land use covenants, all types of community association documents, development agreements, annexation agreements, financing documents, design and construction contracts and all other documentation associated with real estate development.  We assist many of our clients in realizing their dreams of permanently protecting the significant attributes of their properties through conservation easements and other non-development agreements.  Our water law and commercial litigation practice areas compliment our real estate practice by providing technical support in those areas when needed.

Water Law

Our attorneys have expertise in the full range of Water Court adjudications with which a water rights owner may need assistance.  These cases involve such matters as decreeing new water rights; changing the type or location of use of existing water rights; quantifying nontributary ground water withdrawals such as in the Denver Basin aquifer; and adjudicating exchanges and the plans for augmentation.  Our attorneys practice extensively in the Water Courts of Water Division Nos. 1, 2, 4, 5 and 7.  We have won major water rights and water-related cases in the Colorado Supreme Court and in the Colorado Court of Appeals.  See In re: the Application for Water Rights of Double RL Company, 54 P.3d 908 (Colo. 2002); South Adams Water and Sanitation District v. Broe Land Co., 812 P.2d 1161 (Colo. 1991); and Cherokee Water & Sanitation District v. El Paso County, 770 P.2d 1339 (Colo. App. 1988).  As water rights attorneys, a significant portion of our day-to-day practice is devoted to the purchase and sale of water rights, as well as assisting our clients with diligence investigations and evaluations of water rights prior to closing.  These transactions occur in connection with large real estate transactions, or in regard to stand alone water deals.  The practice of Colorado water law involves extensive dealings with the Office of the State Engineer (“OSE”) such as representing clients in proceedings before the OSE to obtain approval for Substitute Water Supply Plans (“SWSPs”).  SWSPs allow water users to operate proposed augmentation plans on a temporary basis pending Water Court approval of the plans.  Our water law practice often complements the Firm’s ongoing real estate and land use work and provides clients with a full range of services on real estate-related projects.

Land Use Matters

In addition to handling land use matters for our real estate and water clients, we have represented numerous clients in hearings before county and state land use commissions and boards.  Representative clients and projects include representation of Melody Homes, Inc. in all major front range communities; before the Boulder County Commissioners over special use permits for Eldora Mountain Resort and for Caribou Ranch regarding water pipeline permitting; representation of Young Life before the Grand County Commissioners regarding special use and 1041 (water and wastewater) permitting; before the Summit County Commissioners regarding the Whatley Ranch planned unit development in Summit County; and before the Town of Winter Park for the new Winter Park Village at the base of Winter Park Resort and the new Lakota residential community adjacent to Winter Park Resort.  We have testified before State of Colorado Senate and House Committees concerning land use and water matters on behalf of our clients.

Commercial Litigation

Johnson & Repucci LLP has an extensive litigation practice, which is built upon the impressive experience and excellent track record of our trial and appellate attorneys.  This experience includes litigating large and complex cases, often with millions of dollars at issue.  Our attorneys have handled the gamut of civil litigation matters, from commercial and business disputes to land use, insurance coverage, real property, eminent domain, contract, construction, employment, commercial landlord/tenant and intellectual property litigation.  Our attorneys have successfully tried cases to many juries, trial courts and arbitrators, and successfully appeared before several appellate courts.

Environmental Matters

Our environmental law attorneys handle all environmental issues related to water, real estate or land use matters, including environmental audits, indemnification agreements, water quality and wetland issues.  This area of our practice, in part, involves representing clients before the Colorado Water Quality Control Commission, obtaining various environmental permits from state and federal agencies, representing clients involved with hazardous waste cleanup under CERCLA, and regulatory compliance, including abatement.
